Purpose and Rationale

Advanced Diploma (AdvDip) in Estate and Trust Administration

Purpose:

The purpose of the Advanced Diploma (AdvDip) in Estate and Trust Administration is to provide individuals with the necessary entry-level academic qualification and skills to become fiduciary practitioners. These practitioners will be able to provide advice on various platforms such as administration of trusts, estate planning, administration of deceased estates, drafting of wills, and legislative issues surrounding the fiduciary services industry. Upon completion of the qualification, the learner will acquire the skills and knowledge necessary to provide advice on fiduciary services for the benefit of individuals or business entities. The learner will be able to:

  1. Demonstrate an advanced understanding of the theoretical framework, key concepts, and core legal rules and principles of all areas of the Fiduciary Services industry.

  2. Explain and apply relevant legislation and the principle of ethics in the Fiduciary Services Industry, specifically in Estate and Trust Management.

  3. Understand and apply all legislative and fiduciary requirements to effectively draft all documentation relevant to the Fiduciary Services industry, specifically in Estate and Trust Management.

  4. Apply theoretical legal knowledge and skills to practical Estate and Trust Administration processes.

Rationale:

The Fiduciary Institute of South Africa (FISA) identified the lack of skills and expertise in the field of estate and trust administration as a strategic priority. The development of the AdvDip in Estate and Trust Administration responds to this need by providing individuals with the academic qualification and skills required to become proficient fiduciary practitioners. The aim is to upgrade skills and establish expertise in fiduciary services.

The Centre for Financial Planning Law (CFPL) at the institution, known for its expertise in tertiary education and training, was approached by FISA to develop this qualification. The CFPL, which currently handles the admittance examinations for FISA members seeking the FPSA designation, is well-positioned to offer this qualification given its academic capacity, capability, and infrastructure. Learners who obtain this qualification can further their studies in related fields such as the LLB Degree, LLM Degree in Financial Planning, or one of the three recently CHE accredited Postgraduate Diplomas in Estate Planning, Employee Benefits, or Investment Planning.

This qualification is suitable for individuals already active in fiduciary services and those looking to enter this profession. It provides academic training for obtaining the professional Fiduciary Practitioner SA (FPSA) designation. Additionally, the AdvDip may serve as an alternate route into formal Law studies for learners who do not meet the LLB admission requirements, enhancing access to legal education.

Outcomes

  4. Apply the theoretical legal knowledge and skills to practical Estate and Trust Administration processes.

Assessment Criteria

Associated Assessment Criteria Exit Level Outcome 1:

  • Apply relevant and important concepts in the Fiduciary Services Industry.
  • Differentiate the roles of various role players in the fiduciary services industry.
  • Identify and distinguish statutory and non-statutory bodies, such as FISA.
  • Identify and distinguish the main regulatory bodies, like the Masters Office, applicable to fiduciary services.
  • List and discuss the functions and structure of the office of the Master of the Supreme court.
  • Apply various statutory regulations in the prevention and prosecution of money laundering crimes.
  • Apply legislation on consumer protection.
  • Apply relevant sections in the given legislation applicable to the delivery of fiduciary services.

Associated Assessment Criteria Exit Level Outcome 2:

  • Evaluate ethical behaviour in the Fiduciary Services Environment.
  • Explain the relevance and application of compliance legislation, including subordinate legislation.

Associated Assessment Criteria Exit Level Outcome 3:

  • Apply legislative formalities applicable to deceased estates, Wills, and the administration of Trusts.
  • Identify and distinguish all applicable authority, such as Case Law and legislation, applicable to the Fiduciary Services Industry.

Associated Assessment Criteria Exit Level Outcome 4:

  • Differentiate various types of trusts.
  • Distinguish the role, powers, duties, rights, and obligations of the various parties to a trust.
  • Evaluate a trust for validity.
  • Apply Section 6 of the Trust Property Control Act regarding the appointment and power of Trustees.
  • Explain legal principles pertaining to the taxation of trusts and their implications.
  • Critically interpret anomalies in the SA law of trusts.
  • Apply principles underlying the administration of a trust practically.

Integrated Assessment:

  • Use a variety of assessment methods to assess applied competence.
  • Ensure assessment purposes are formative and summative.
  • Clearly articulate competencies to be assessed in terms of relevant learning outcomes.
  • Align assessment strategy and activities with assessment purpose, competencies, context, knowledge, skills, attitudes, learning outcomes, Assessment Criteria, and requirements for a NQF Level 7 qualification.
