Purpose and Rationale

Purpose:

The purpose of this qualification is to equip prospective learners with general and specialist knowledge in mediation with regards to family disputes, divorce proceedings, and commercial disputes. The qualification aims to enhance the skills of learners so that they can become effective mediators, encouraging discussions and gaining a greater understanding of disputes. Learners will be equipped to facilitate reconciliation by assisting disputing parties in communicating and exploring their issues, establishing fair procedures that allow all sides to be heard. The goal is to develop mediators who can help parties in conflict achieve settlement through confidential, risk-free mediation processes. The qualification also aims to develop theoretical competencies and practical skills for individuals to operate effectively as mediators in various conflict management interventions.

Rationale:

There is a crucial need for skilled mediators who can listen and help parties identify the underlying causes of conflict to resolve or manage their problems. The international community is expected to actively resolve conflicts and prevent disputes. Maintaining confidentiality in the mediation process is paramount, requiring mediators to uphold confidentiality and avoid compromising actions or statements. The qualification aims to develop mediators who propose flexible, values-based strategies while presenting a common vision to parties in dispute. Mediators are key in promoting better relationships through cooperative problem-solving and improved communication, essential for dealing with conflict situations effectively.

Outcomes

  1. Gather, evaluate and manage information required for the mediation process in order to reach an amicable solution for all parties involved.
  2. Develop advanced knowledge of theoretical concepts and skills underlying a range of approaches to mediation in a variety of settings.
  3. Demonstrate an advanced understanding of fundamental principles of ethics in a comparative multi-disciplinary perspective.
  4. Demonstrate integrated knowledge and understanding of mediation and alternative dispute resolution.

Assessment Criteria

Associated Assessment Criteria for Exit Level Outcome 1:

  • Management of a relationship between conflicting parties.
  • Application of knowledge and skills in conducting a mediation meeting.
  • Application of knowledge acquired to solve problems in the mediation context.
  • Evaluation of the process and techniques used for reference.

Associated Assessment Criteria for Exit Level Outcome 2:

  • Application of theory and best practices in mediation between family members, couples, parents, and within the corporate environment.
  • Analysis of different process models: family, community, business stages of the process: pre-mediation/case development and mediation parts.
  • Application of mediation styles: facilitative, evaluative, transformative, problem-solving process management.
  • Identification of mediation skills, techniques, and behaviors including rapport and negotiation skills.
  • Consideration and use of contexts and different approaches when dealing with conflict and impasse.

Associated Assessment Criteria for Exit Level Outcome 3:

  • Understanding, observing, and adhering to mediation principles, codes of ethics, ethical dilemmas, values, and principles.
  • Application of key principles and practices underpinning Mediation.
  • Following ethical guidelines and principles including empowerment, mutual respect, and equity of exchange.

Associated Assessment Criteria for Exit Level Outcome 4:

  • Development and communication of ideas, possible solutions, and proposals based on problem-solving methods within the mediation process.
  • Comprehensive description of personal learning and development journey.
  • Presentation of informed practice and findings showing evidence of critical thinking and analysis.
  • Demonstration of core communication skills required in skilful mediation.
  • Preparation of a case for mediation including drafting effective position papers.
  • Citation of regulation and case law relevant to the field of alternative dispute resolution (ADR).

Integrated Assessment:

  • Different methods of assessment aligned with the assessment criteria and prescribed assessment methods.
  • Use of formative and summative assessment to determine achievement of desired outcomes.
  • Summative assessment through a written examination at the end of each semester.
  • Continuous assessment for the Work Integrated Learning component including role play, case studies, and portfolios.
  • Formative assessment including tests, group and individual assignments, case studies, and portfolios.
